These Terms of Service ("Terms") govern the use of the services offered under the brand Goter Hosting by PREBAIRD PRIVATE LIMITED ("we", "us"), LR Plot No 314, Kalabari, Near Sani Mondir, Siliguri, Darjeeling, West Bengal - 734003. By ordering or using any service you agree to these Terms.
1. Services
We provide domain registration, shared hosting, VPS, dedicated servers, SSL certificates and related services as described on our website. Specifications and prices may change; changes apply from your next renewal.
2. Account and information
You must provide accurate and complete contact details and keep them up to date. You are responsible for all activity under your account and for keeping your passwords safe.
3. Payment and renewal
- Services are billed in advance for the selected billing cycle.
- Renewal invoices are sent before the due date. Unpaid services may be suspended after the due date and terminated later, which can lead to permanent loss of data.
- Domain names that are not renewed in time may enter grace / redemption periods where the registry charges extra fees, or may be lost.
- Prices exclude GST, which is charged as per Indian law.
4. Acceptable use
You may not use our services for anything illegal or harmful, including but not limited to: spam or unsolicited bulk e-mail, phishing, malware, hacking, copyright or trademark infringement, child sexual abuse material, fraud, or content that violates Indian law. Shared hosting resources must not be used in a way that harms other customers (e.g. excessive CPU usage, mining, public file storage). We may suspend services that violate this policy without notice. 5. Backups
We take regular backups as a courtesy, but you are responsible for keeping your own backups of your website, databases and e-mail.
6. Domain names
Domain registrations are subject to the rules of the relevant registry and ICANN. Registration is not guaranteed until confirmed by the registry. Ownership details must be accurate; incorrect WHOIS data can lead to suspension by the registry.
7. Uptime and liability
We aim for 99.9% uptime but do not guarantee uninterrupted service. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected service in the last three months. We are not liable for indirect losses such as loss of profit or data.
8. Cancellation and refunds
You can cancel at any time from your client area. Refunds are governed by our Refund Policy and Money Back Guarantee.
9. Termination by us
We may suspend or terminate services for non-payment, abuse, fraud, or breach of these Terms.
10. Governing law
These Terms are governed by the laws of India. Courts at Siliguri, West Bengal shall have exclusive jurisdiction.
